These Terms of Service ("Terms") govern your use of trackmounts.com (the "Site") and your purchase of products from TrackMounts LLC ("TrackMounts LLC," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.

1. Eligibility

You must be at least 18 years old to make purchases from TrackMounts LLC. By placing an order, you represent that you are 18 or older and have the legal capacity to enter into a binding contract.

2. Products and Description

TrackMounts LLC manufactures and sells accessory products designed to attach electronic tracking devices (such as Apple AirTag and similar Bluetooth trackers) to walking canes, walking sticks, and similar cylindrical mobility aids. We make every effort to display product descriptions, dimensions, photographs, and compatibility information accurately. However, we do not warrant that product descriptions or other content on the Site are perfectly accurate, complete, current, or error-free.

Colors, finishes, and proportions may appear differently on different screens. Minor manufacturing variations may occur and do not constitute defects.

3. Important Product Use Disclaimers

The TrackMount is an accessory product, not a medical device or safety device. Please read these disclaimers carefully:

- The TrackMount is designed to hold a tracking device on a cane or mobility aid. It is not intended to provide structural support, balance assistance, or any function related to the safe operation of the mobility aid itself.

- The TrackMount does not prevent falls, loss, theft, or injury. Tracking devices used with the TrackMount may fail, lose battery, lose connection, or be otherwise unable to locate a missing item.

- The TrackMount is not a substitute for personal supervision, professional caregiving, or medical alert services. Users with medical conditions, mobility impairments, or who require emergency assistance should rely on appropriate medical alert systems, not on tracking accessories.

- It is the customer's responsibility to verify that the TrackMount is compatible with their specific mobility aid before use. Compatibility specifications and a sizing guide are provided on every product page.

- The TrackMount must be properly installed and periodically inspected for tightness, wear, or damage. We are not responsible for issues arising from improper installation or failure to inspect the product.

⚠️ WARNING — Proper Installation is Required for Safety. The TrackMount must be installed on the cane in alignment with the cane's handle, oriented in the same direction as the handle. Installing the TrackMount perpendicular to or opposite the handle creates multiple protrusion points on the cane, which may increase the risk of injury in the event of a fall. Aligning the device with the handle creates a single predictable impact profile and reduces this risk. Refer to the included installation instructions before use.

Use Restrictions. The TrackMount is a mechanical retention device that secures around a cylindrical object using inward compression. When attached, the TrackMount could limit the natural movement of the object to which it is attached. The TrackMount must therefore only be used on objects whose function does not depend on unimpeded freedom of movement. Mobility aids — including walking canes, walking sticks, walkers, crutches, rollators, wheelchairs, and similar assistive devices — are designed for static, supportive use and are appropriate for the TrackMount. Do not install the TrackMount on any object that requires uninterrupted freedom of movement to function safely, including but not limited to:

- Bicycle, scooter, motorcycle, or any other vehicle handlebars
- Sporting equipment during use (ski poles, hockey sticks, golf clubs, fishing rods, etc.)
- Children's toys or play equipment in use
- Any moving, rotating, vibrating, or operator-controlled equipment

The user is responsible for evaluating whether any object's safe function depends on unimpeded movement before attaching the TrackMount. Use of the TrackMount on any object that requires freedom of movement during operation is not authorized and may result in injury, property damage, or product failure.

4. Tracking Device Compatibility

The TrackMount is designed to hold standard-sized Bluetooth tracking devices, including Apple AirTag and similar trackers. We are not affiliated with, endorsed by, or sponsored by Apple Inc. or any other tracking device manufacturer. Apple, AirTag, and related marks are trademarks of their respective owners. Compatibility with specific tracking device models may change over time. Customers are responsible for confirming current compatibility before purchase.

5. Orders, Pricing, and Payment

All prices are listed in U.S. dollars and are subject to change without notice. Prices in effect at the time you place your order will apply. We reserve the right to refuse or cancel any order at our discretion, including for reasons such as suspected fraud, pricing errors, or product unavailability. If we cancel an order after payment, we will refund the full amount.

You agree to provide accurate, current, and complete information for all purchases. You are responsible for maintaining the confidentiality of any account credentials you create on the Site.

6. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy. We are not responsible for shipping carrier delays, lost or damaged packages once delivered to the carrier, or incorrect addresses provided by the customer. Risk of loss transfers to the customer upon delivery to the shipping carrier.

7. Returns and Refunds

Returns and refunds are governed by our Refund and Return Policy. By purchasing, you agree to the terms of that policy.

8. Intellectual Property

All content on the Site — including product designs, photographs, text, graphics, logos, the TrackMount name and trademark, and all related intellectual property — is owned by TrackMounts LLC or our licensors and is protected by U.S. and international intellectual property laws. The TrackMount is patent pending and protected by additional intellectual property rights.

You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works of our products, designs, or Site content without our prior written permission. Unauthorized use may result in legal action.

9. User Conduct

You agree not to:

- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to the Site, our systems, or other users' accounts
- Submit false or misleading information
- Use the Site or our products in any manner that could damage, disable, overburden, or impair our operations
- Resell our products without prior written authorization

10. Warranties and Disclaimers

Express Warranty: TrackMounts LLC warrants that the TrackMount will be free from defects in material and workmanship under normal use for ninety (90) days from the date of delivery. This warranty applies only to the original purchaser and is non-transferable.

If a defect is found within the warranty period, your sole remedy is, at our option, repair, replacement, or refund of the purchase price. To make a warranty claim, contact us at contact@trackmounts.com with your order number, a description of the defect, and photos of the affected product.

Implied Warranties: Implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the duration of the express warranty above (ninety days), to the maximum extent permitted by applicable law. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.

Exclusions: This warranty does not cover damage or defects resulting from:

- Misuse, abuse, accident, or neglect
- Modification, alteration, or repair not authorized by TrackMounts LLC
- Use outside the stated compatibility specifications (cane diameters outside 7/16" to 7/8")
- Improper installation, including installation in any orientation other than aligned with the cane's handle
- Use on any object other than approved mobility aids (see Section 3)
- Normal wear and tear
- Loss, theft, or damage to tracking devices used with the product
- Failure of any third-party tracking device

Site Content: Information, descriptions, and content on trackmounts.com are provided for informational purposes. We make reasonable efforts to ensure accuracy but do not warrant that Site content is error-free, complete, or current. We do not warrant uninterrupted access to the Site.

No Warranty for Tracking Functionality: The TrackMount is an accessory product. We do not warrant the performance, accuracy, range, or reliability of any tracking device used with our product. Tracking device functionality is governed solely by the manufacturer of the tracking device (e.g., Apple Inc. for AirTag).

Your Statutory Rights: This warranty gives you specific legal rights, and you may also have other rights that vary by state or jurisdiction. Nothing in these Terms is intended to limit any rights you have under applicable consumer protection laws, including the California Song-Beverly Consumer Warranty Act.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRACKMOUNTS LLC, ITS OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies regardless of the legal theory of liability (contract, tort, strict liability, or otherwise) and survives the termination of these Terms.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless TrackMounts LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms, (b) your misuse of our products, (c) your violation of any third-party rights, or (d) your violation of any applicable law.

13. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our products shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall be conducted in Sacramento County, California, or remotely if both parties agree.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Small Claims Exception: Either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits, in lieu of arbitration.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to contact@trackmounts.com within 30 days of your first purchase. Opting out will not affect any other provisions of these Terms.

14. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of laws principles. For any dispute not subject to arbitration, the exclusive venue shall be the state or federal courts located in Sacramento County, California, and you consent to the jurisdiction of such courts.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. The most current version will always be posted on this page with an updated "Last updated" date. Your continued use of the Site or purchase of our products after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Shipping Policy, Refund and Return Policy, Privacy Policy, and any other policies posted on the Site, constitute the entire agreement between you and TrackMounts LLC regarding your use of the Site and purchase of our products.
